1. Introduction

Welcome to NESTS Construction Service Platform. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

These terms apply to users in Zimbabwe, South Africa, and other jurisdictions where we operate. Certain provisions may be modified to comply with local data protection and consumer laws.

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding contracts.

You agree to use the platform only for lawful purposes. You may not: misuse contractor or client data, harass other users, circumvent escrow or payment systems, or use the platform for fraud.

We reserve the right to suspend or terminate accounts that violate these rules.

A Spot Checker is a vendor who inspects work quality on other vendors' projects. Opting in at registration (or when an admin enables this on your profile) means you agree to serve as an independent quality checker when a client requests one. It does not assign a Spot Checker to jobs where you are the contractor.

If you opt in, you may be invited or selected on projects other than ones you are contracted to build. You review milestone proof and accept or reject it. Your verdict can affect whether the client may release payment for that milestone.

You must stay independent. You cannot be the contractor and the Spot Checker on the same project. If you accept a Spot Checker assignment, you cannot bid as the contractor on that project. Disclose any conflict of interest and decline work you cannot inspect impartially.

Spot Checker fees are billed to the client and paid through escrow. They are separate from the contractor's bid. NESTS may require approval before you appear as an available Spot Checker, and may suspend this role if you breach these terms. You can change this preference later by contacting support.
